Introduction

Welcome to Survival Enhanced. By accessing or using SurvivalEnhanced.com, our Discord community, ARK: Survival Ascended servers, store, account systems, events, or other related services operated by Survival Enhanced, you agree to these Terms of Service. If you do not agree to these terms, do not use Survival Enhanced services.

1. Overview

Survival Enhanced operates an independent ARK: Survival Ascended gaming community, including game servers, community features, websites, account tools, digital services, optional memberships or perks, events, and related systems.

Survival Enhanced is an independent, unofficial gaming community. Survival Enhanced is not affiliated with, endorsed by, sponsored by, approved by, or officially connected to Studio Wildcard, Snail Games, ARK: Survival Ascended, Microsoft, Sony, Steam, Epic Games, or other publishers, platforms, or trademark owners unless expressly stated.

All third-party game names, trademarks, logos, and related assets belong to their respective owners.

2. Eligibility

Survival Enhanced is an adult-oriented community.

Users must meet any minimum age requirements stated in Survival Enhanced community rules and must also meet the legal age requirements applicable to the services and platforms they use.

Users are responsible for ensuring they are legally permitted to access Survival Enhanced services in their jurisdiction.

3. Accounts and Account Security

Users are responsible for maintaining the security of their Discord, game, website, platform, and connected accounts.

Users must not:

• impersonate another player, staff member, or organization;
• attempt to bypass bans, restrictions, suspensions, or account limitations;
• access another person's account without authorization;
• misuse account linking or verification systems;
• exploit authentication, recovery, or support systems.

Survival Enhanced may restrict or terminate access when accounts are used in violation of these Terms, community rules, server rules, or security requirements.

4. Server Rules and Community Conduct

All players must follow the current Survival Enhanced Cluster Rules and any applicable Discord rules, event rules, or posted community guidelines.

Rules may be updated when necessary for:

• gameplay balance;
• server stability;
• community safety;
• exploit prevention;
• game or mod updates;
• administrative or technical requirements.

Violations may result in warnings, structure removal, character or tribe action, temporary suspension, permanent bans, or other appropriate enforcement.

5. Gameplay, Cheating, and Exploits

Users may not:

• cheat;
• mesh;
• dupe;
• exploit bugs;
• intentionally circumvent server mechanics;
• use unauthorized tools or automation;
• interfere with server systems;
• exploit store, account, event, casino, recovery, or reward systems.

Survival Enhanced may investigate gameplay logs, server logs, moderation records, and other relevant information when enforcing rules.

6. Digital Purchases, Memberships, and Perks

Survival Enhanced may offer optional digital items, memberships, ranks, convenience features, cosmetics, tokens, account benefits, or other digital services.

Digital purchases:

• have no real-world cash value;
• do not represent ownership of game assets;
• do not guarantee permanent availability;
• may be changed, replaced, adjusted, rebalanced, or discontinued;
• do not provide immunity from server rules or enforcement.

A purchase does not guarantee:

• permanent access to Survival Enhanced;
• specific gameplay results;
• uninterrupted server availability;
• permanent availability of a specific perk or feature;
• protection from balance changes, game updates, mod updates, bugs, rollbacks, or technical failures.

7. Payments and Third-Party Store Providers

Purchases may be processed through third-party platforms or payment processors.

Survival Enhanced does not directly store full payment-card information.

Third-party payment providers may process transaction information under their own terms and privacy policies.

Survival Enhanced may receive limited order information necessary to:

• fulfill purchases;
• provide customer support;
• verify payments;
• investigate fraud;
• address payment disputes.

8. Refunds

Because Survival Enhanced primarily provides digital goods, memberships, perks, or services, purchases may be non-refundable after delivery, activation, redemption, or use except where required by applicable law or where Survival Enhanced chooses to provide a refund, replacement, store credit, or other accommodation.

Refunds are not automatically owed because of:

• gameplay balance changes;
• server downtime;
• ARK updates;
• mod updates;
• technical problems;
• player bans or enforcement;
• user error;
• failure to read product descriptions or requirements.

9. Chargebacks and Payment Disputes

Fraudulent or abusive chargebacks may result in account restrictions while the dispute is investigated.

Survival Enhanced may use transaction records, fulfillment records, account activity, and relevant logs when responding to payment disputes.

10. Server Availability

Survival Enhanced works to maintain stable long-term servers but does not guarantee uninterrupted operation.

Servers may require:

• restarts;
• maintenance;
• updates;
• configuration changes;
• emergency fixes;
• rollbacks;
• migrations;
• temporary shutdowns.

Service interruptions may result from game updates, hosting providers, mods, plugins, attacks, bugs, exploits, hardware failures, software failures, or third-party services.

11. No-Wipe Policy and Data Loss

Survival Enhanced is operated as a long-term no-scheduled-wipe cluster.

However, “no wipes” does not mean that technical data loss can never occur.

Unexpected circumstances may include:

• corrupted saves;
• game bugs;
• exploits;
• hardware failure;
• ransomware or malicious attacks;
• hosting failures;
• catastrophic technical incidents;
• emergency rollback requirements.

Survival Enhanced does not guarantee restoration of every lost item, creature, structure, character, reward, or other game asset.

Recovery or compensation may be provided when staff determines it is appropriate and technically possible.

12. Events, Giveaways, Casino, and Rewards

Survival Enhanced may operate events, giveaways, tournaments, casinos, competitions, or other community reward systems.

Event terms, eligibility, schedules, rewards, and rules may vary.

Survival Enhanced may modify, delay, cancel, substitute, deny, or remove rewards when necessary because of:

• cheating;
• exploitation;
• system abuse;
• technical failure;
• rule violations;
• suspicious activity;
• event errors.

Digital community rewards have no guaranteed real-world monetary value unless explicitly stated otherwise.

13. User Content

Users may submit or create:

• messages;
• screenshots;
• videos;
• clips;
• feedback;
• suggestions;
• player or tribe names;
• support tickets;
• community posts.

Users remain responsible for content they submit.

By submitting content to Survival Enhanced-controlled spaces, users grant Survival Enhanced permission to store, display, reproduce, or use that content where reasonably necessary for:

• operating the community;
• moderation;
• support;
• security;
• investigation;
• community promotion.

14. Intellectual Property

Original Survival Enhanced branding, custom written content, website design elements, community materials, and original systems may be owned or licensed by Survival Enhanced.

ARK: Survival Ascended and related game assets, trademarks, names, logos, and intellectual property belong to their respective owners.

Survival Enhanced does not claim ownership of Studio Wildcard, Snail Games, or other third-party intellectual property.

15. Prohibited Activities

Users may not:

• attack or disrupt Survival Enhanced systems;
• attempt unauthorized access to servers, databases, staff systems, accounts, APIs, or administration tools;
• cheat, exploit, dupe, mesh, or intentionally abuse bugs;
• impersonate staff or other users;
• evade bans;
• abuse payment systems;
• submit fraudulent recovery or support claims;
• exploit community reward systems;
• intentionally harm infrastructure or community services.

16. Third-Party Services

Survival Enhanced relies on third-party providers that may include:

• Discord;
• game platforms;
• server hosts;
• cloud infrastructure;
• payment processors;
• store providers;
• database providers;
• authentication providers;
• analytics or security tools.

Use of those services may also be governed by their own terms and privacy policies.

Survival Enhanced is not responsible for third-party outages, account actions, platform restrictions, data loss, service interruptions, or policy changes outside Survival Enhanced's control.

17. Disclaimer of Warranties

Survival Enhanced services are provided on an “as is” and “as available” basis to the extent permitted by law.

Survival Enhanced does not guarantee that every service will always be:

• uninterrupted;
• error-free;
• secure;
• compatible;
• continuously available.

18. Limitation of Liability

To the fullest extent permitted by applicable law, Survival Enhanced and its operators, administrators, moderators, contractors, or volunteers are not responsible for indirect, incidental, special, consequential, or punitive damages arising from use of Survival Enhanced services.

This may include loss of:

• game progress;
• characters;
• creatures;
• bases;
• virtual items;
• rewards;
• access;
• event opportunities.

Nothing in these Terms excludes liability that cannot legally be excluded.

19. Termination

Survival Enhanced may restrict, suspend, or terminate access to its services when users:

• violate these Terms;
• violate community or server rules;
• engage in fraud;
• create security risks;
• abuse staff or systems;
• cause harm to the community or infrastructure.

Termination does not automatically create a right to refund digital purchases except where required by law.

20. Changes to These Terms

Survival Enhanced may update these Terms of Service.

Material changes should be reflected by updating the effective date on this page.

Continued use of Survival Enhanced services after updated terms become effective constitutes acceptance to the extent permitted by applicable law.
